โšก The short answer
Free legal aid means the State pays for your lawyer, fees and paperwork when you can't. Article 39A directs it, and the Supreme Court read it into Article 21: a poor accused must get a lawyer at State cost, from his first hearing before a magistrate to the final appeal, without even asking.
๐ŸŽฌ The 30-second story

Tara's ruling: Rohan gets a free lawyer from his first appearance, when bail is decided. The magistrate had to tell him; a trial without offering one could be set aside.

Justice has a price tag: lawyers, court fees, photocopies, lost wages. Free legal aid removes it for people who can't pay, so your wallet doesn't decide your rights.

A lawyer at State cost

A passage will say: โ€œA person in a listed category is entitled to free legal aid if he has a genuine case to prosecute or defend.โ€ Three tests: a category, a case, and a genuine one.

๐Ÿ“Œ What CLAT actually expects
The passage tells you who qualifies and what aid covers. Match the facts to that list exactly. Wealth, guilt and the crime's seriousness matter only if the passage says so.

How did a Directive Principle become a right you can enforce?

Article 39A sits among the Directive Principles, which courts can't enforce directly. The way in was Article 21: after Maneka Gandhi, any procedure taking liberty must be fair. Is a trial fair when one side can't afford a lawyer? No, said the Court in Hoskot and Hussainara Khatoon.

When does the right to a free lawyer kick in?

๐Ÿ•’ Timeline
From arrest to the Supreme Court
  1. ๐Ÿš“
    Arrest
    Arrest
You may consult a lawyer; free aid in the police station is less settled.
  2. ๐Ÿ›๏ธ
    Day 1
    First production before a magistrate
Free aid attaches here and at every remand, as bail is argued now (Khatri).
  3. ๐Ÿ“‹
    Trial
    The trial
No lawyer offered: trial vitiated, even if the accused never asked (Suk Das).
  4. ๐Ÿ“„
    Appeal
    Judgment copy and appeal
A timely copy of the judgment and an assigned lawyer (Hoskot).
  5. ๐Ÿ
    Top court
    Supreme Court
Aid runs from the lowest court to the highest.

The burden sits with the court, not the accused. Most people before a magistrate have never heard of legal aid, and a right you must already know about is a paper promise. So the magistrate must tell every unrepresented accused. Silence is not a waiver.

โš ๏ธ The 'he never asked' trap
โ€œNo aid was due because the accused never appliedโ€ is almost always wrong. The real exception: an accused who is told and refuses a lawyer can't complain later.

Where does the right stop?

Under the legal services law, anyone who must file or defend a case gets in by one of two routes: the status route (a vulnerable group, whatever your bank balance) or the income route (below a government-fixed limit).

๐Ÿงฉ At a glance
Who qualifies
๐Ÿ‘ฉWomen
Rich or poor.
๐Ÿง’Children

๐ŸŒŠDisaster or violence victims
Flood, earthquake, caste or ethnic violence.
โ›“๏ธTrafficking or begar victims
Begar is forced, unpaid labour.
๐Ÿ’ฐLow income
The only route with a money test.

Is a rich person ever entitled?

โš ๏ธ The rich-man trap
Yes. Status categories carry no income test: a millionaire in a lock-up is a person in custody. Don't import โ€œhe can afford a lawyerโ€ unless the passage makes income a condition.
๐Ÿงญ Decision flow
Am I entitled to free legal aid?
โ“ Do you have a case to file or defend, or need advice the rule covers?

โ“ Is your income below the limit?
No โ†’
Not entitled: hire your own lawyer
Lok Adalats are still free for all.
Yes โ†“

What does it cover, and what does 'genuine' filter out?

Free doesn't mean unlimited: the authority must see a real case, not a sure win. Someone suing only to harass a neighbour fails, however neatly she fits a category. And since entitlement is personal, both sides of one dispute can get aid.

What are Lok Adalats, and how are they different from courts?

Lok Adalat means โ€œpeople's courtโ€: a free, informal forum where a judicial officer helps the parties settle. It takes cases pending in court or disputes that haven't reached one. No court fee, and any fee paid is refunded on settlement.

โš”๏ธ Side by side
Lok Adalat vs Permanent Lok Adalat
๐ŸคLok Adalat
settles by consent
  • โ€ขCivil disputes, compoundable offences
๐ŸขPermanent Lok Adalat
can decide if talks fail
  • โ€ขPublic utilities: transport, power, water, telecom, hospitals, insurance
TestLok AdalatPermanent Lok Adalat
No settlement?Back to court; no awardDecides on merits
Appeal against award?NoneNone
Non-compoundable crimes?ExcludedExcluded

The ordinary Lok Adalat only seals a deal; the Permanent one can rule.

So: no consent, no award. A settled award is final, with no appeal, because the parties agreed to it. And crimes the law won't let parties compromise, like murder, stay out.

Landmark case ยท 1978 ยท Supreme Court
M.H. Hoskot v State of Maharashtra
๐Ÿ“‹
What happened
A convicted university reader said the jail never gave him the High Court's judgment. His appeal came four years late, after he had served his sentence.
โ“
The question
Does Article 21 require a judgment copy and a lawyer for the appeal?
๐Ÿ”จ
What the court held
Yes. Both are State duties; the Court can assign counsel, and the State pays.
What CLAT takes from it: The right of appeal must be real, not just on paper.
๐Ÿ”’
Landmark case ยท 1979 ยท Supreme Court
Hussainara Khatoon v Home Secretary, State of Bihar
๐Ÿ“‹
What happened
Thousands of undertrials sat in Bihar's jails, some longer than the maximum sentence for their alleged offence, many without a lawyer.
โ“
The question
Is free legal aid for a poor accused part of Article 21?
๐Ÿ”จ
What the court held
Yes. The State must provide a lawyer the accused doesn't object to. Speedy trial is part of Article 21 too.
What CLAT takes from it: Legal aid became a right, not charity.
๐Ÿ‘๏ธ
Landmark case ยท 1980 ยท Supreme Court
Khatri v State of Bihar (Bhagalpur blindings)
๐Ÿ“‹
What happened
Police blinded undertrials in Bhagalpur. Magistrates gave them no lawyers, saying none had been asked for.
โ“
The question
When does the right begin, and must the accused ask?
๐Ÿ”จ
What the court held
At first production before a magistrate. Magistrates must inform the accused, and the State can't plead lack of money.
What CLAT takes from it: The duty to inform is the court's. Suk Das later set aside a conviction for exactly this failure.
๐Ÿ“ Asked in CLAT 2018 ยท Q157 Why the State owes legal aid
Directions: โ€ฆ two statements, one labeled as โ€˜Assertionโ€™ (A) and another as โ€˜Reasonโ€™ (R) โ€ฆ Assertion (A): It is the legal and constitutional duty of the State to provide legal aid to the poor. Reason (R): No one should be denied justice by reason of his poverty.

Choose the correct code.

ABoth A and R are individually true and R is the correct explanation to A
BBoth A and R are individually true but R is not the correct explanation to A
CA is true but R is false
DA is false but R is true
Reveal answer + reasoning
Answer: A
Both are true, and R is the very purpose Article 39A states, so it explains A. (The paper numbered options 1โ€“4; the key gives 1.)
Why the others fail
  • B โ€” R is the reason the duty exists, not a side fact.
  • C โ€” R is Article 39A's stated goal.
  • D โ€” Courts enforce the duty through Article 21.
๐Ÿ“ Asked in CLAT 2023 ยท Q90 The rich man in custody
Free legal aid is the provision of free legal services in civil and criminal matters for those poor and marginalised people who cannot afford the services of a lawyer โ€ฆ Free legal aid must be provided to the needy from the lowest court to the Supreme Court of India. According to Section 13(1) of the Act, any individual who satisfies any criteria under Section 12 is entitled to receive free legal aid, provided that NALSA is satisfied that such person has a genuine case to prosecute or defend the matter. There is hence no bar as to which kind of cases one can apply and not apply for. Section 12 of the Act includes the following: โ€ข a member of a Scheduled Caste or Scheduled Tribe; โ€ข a woman or a child; โ€ข a person with a disability; โ€ข an industrial workman; or โ€ข a person in police custody.

Vikram is a rich businessman and has a huge art collection. Farhan invites Vikram to his studio one day, hoping to convince Vikram to buy some of his paintings. Vikram doesnโ€™t buy any of his paintings, but after he leaves, Farhan notices that one of his newest paintings is missing. He suspects that Vikram has stolen it, and complains to the police, who promptly arrest Vikram. Vikram approaches NALSA for free legal aid, so that he can obtain bail. Is Vikram entitled to free legal aid from NALSA?

ANo, since he is a rich businessman and can hire a lawyer with his own money.
BYes, since he was innocent.
CYes, since he was in police custody.
DNo, since he had stolen from a struggling artist.
Reveal answer + reasoning
Answer: C
Wealth is the red herring. โ€œA person in police custodyโ€ carries no income condition, and guilt is for the trial.
Why the others fail
  • A โ€” No income test on the custody category.
  • B โ€” Innocence isn't decided, and isn't the test.
  • D โ€” Guilt is unproven and no case type is barred.

The rest of that 2023 set: Divya, a woman, gets aid for her Supreme Court appeal (Q86, C) but not for a revenge complaint (Q87, A); her opponent Riya can't be refused just because Divya is aided (Q88, D); and Farhan, a poor artist, gets nothing though scheme advice is covered, because he fits no listed category (Q89, B).

๐ŸŽฏ Quick quiz
Quick quiz: legal aid and Lok Adalats
0 / 5
Rule: Every woman or child with a genuine case gets free legal aid. Meher, 16, a rich hotelier's daughter, is sued over a scooter accident and has a genuine defence.

Q1. Is Meher entitled?

Rule: A poor accused gets a lawyer at State cost, and the magistrate must tell him so. Rohan is tried for theft unrepresented; nobody mentions legal aid and he never asks.

Q2. Rohan's best ground of appeal?

Rule: The State cannot escape its legal aid duty by pleading lack of funds. A State seeks a six-month exemption, citing an empty budget.

Q3. Should it be granted?

Rule: A Lok Adalat award is final; no appeal lies. Aarav settles with Zoya there, agreeing to pay โ‚น2 lakh, then regrets it and appeals.

Q4. What happens?

Rule (changed): Free legal aid only for those earning below โ‚น3 lakh a year, whatever their category. Vikram, earning โ‚น50 lakh, is in police custody and seeks aid for bail.

Q5. Is he entitled now?

๐ŸŽฏ Free legal aid in a nutshell
  • Article 39A directs; Article 21 makes it a right of the accused.
  • It starts at first production before a magistrate and runs to the Supreme Court.
  • The court must tell you; not asking isn't waiving.
  • Entitled = category or low income, plus a genuine case.
  • Lok Adalat awards are final: no appeal.
๐Ÿ“Ž Good to know, not to memorise
  • Article 39A: added by the 42nd Amendment, 1976. Article 22(1): an arrested person may consult a lawyer of his choice.
  • Legal Services Authorities Act, 1987, in force 9 November 1995 (National Legal Services Day): section 12 (who is entitled), section 13 (genuine case). NALSA's Patron-in-Chief is the Chief Justice of India.
  • Lok Adalats: sections 19โ€“22; Permanent Lok Adalats added in 2002. Awards can be challenged only by writ, on narrow grounds such as fraud.
  • Section 341 BNSS (formerly 304 CrPC): Sessions Court assigns a lawyer at State expense.

Frequently asked questions

Who is eligible for free legal aid in India?
Anyone with a genuine case to file or defend who is a woman, a child, an SC or ST member, disabled, an industrial workman, in custody, a victim of disaster, violence or trafficking, or earning below the government's income limit.
Is free legal aid a fundamental right?
Article 39A is a Directive Principle and can't be enforced alone. But the Supreme Court held that a fair procedure under Article 21 includes a free lawyer for an accused who can't afford one. That part is a fundamental right.
Does an accused have to apply for free legal aid?
No. The magistrate must tell an unrepresented accused that a lawyer is available at State cost. In Suk Das a conviction was set aside because the accused was never told, though he never asked. One who is told and refuses can't complain later.
Can you appeal against a Lok Adalat award?
No. The award is treated as a civil court decree and is final, because the parties agreed to it. Without agreement, an ordinary Lok Adalat makes no award and the case returns to court. A High Court writ is possible only on narrow grounds like fraud.
Can a rich person get free legal aid?
Yes, through a category with no income test, such as a woman, a child or a person in police custody. CLAT 2023 asked about a rich businessman arrested for theft; he was entitled because he was in custody. Only the low-income route checks money.
