What counts as cruelty against a married woman?
Everyday English uses cruel loosely. Criminal law can't, so it uses a narrow, defined meaning.
A passage will say: 'Whoever, being the husband or the relative of the husband of a woman, subjects such woman to cruelty shall be punished.' Fail any gate and there's no offence.
What are the two kinds of cruelty?
- โขDeliberate, not accidental
- โขLikely to drive her to suicide, or to cause grave injury or danger to life, limb or health, physical or mental
- โขTo make her or her family meet an unlawful demand for property
- โขOr because they didn't meet it
| Test | Grave wilful conduct | Harassment for property |
|---|---|---|
| Injury needed? | Conduct must threaten grave harm | No. The pressure is the wrong |
| Key word | Wilful | Unlawful demand |
Either limb is enough.
Wilful means deliberate. Likely means you judge the conduct by its nature, not by whether she broke down. The second limb doesn't need the word dowry: cash for a flat counts. Harassment means a course of conduct, not one request.
Is it cruelty? Work it out in four questions
Where does cruelty stop?
Is asking a wife to do housework cruelty?
Not by itself. In the case behind CLAT 2023, a High Court quashed a complaint that the wife was treated 'like a maid servant'. Household work for the family is part of running a home. Treatment like a servant, with abuse or deprivation, is different, and the complaint must show which it was.
Are vague allegations enough?
No. 'Harassed mentally and physically', without who did what, and when, doesn't make out the offence. In Dara Lakshmi Narayana v State of Telangana (2024), the Supreme Court quashed a case against the husband's relatives because the allegations were vague and general.
Who counts as a relative of the husband?
This is a penal law, so 'relative' is read strictly: tied to the husband by blood, marriage or adoption. A stranger who torments her may commit hurt or intimidation, but not this offence.
What if the marriage is void, or over?
A man who marries her while already married can't escape by calling the marriage void: the Supreme Court reads 'husband' to cover anyone who takes on that role. But after a divorce, he isn't her husband, so fresh cruelty falls outside this offence. Acts done during the marriage stay punishable.
An affair? Not cruelty by itself. In Pinakin Mahipatray Rawal v State of Gujarat (2013), it counted only if of a nature likely to drive the wife to suicide.
What is dowry death?
The prosecution needn't prove who lit the match. If four facts line up, the husband or relative is deemed to have caused the death.

Soon before isn't immediately before. Courts want a proximate and live link: harassment that hadn't gone stale. Once the four facts are proved, the court presumes the accused caused the death and he must rebut it. The minimum sentence is seven years.
- โขNo time limit after marriage
- โขWithin 7 years of marriage

Not alternatives: both can be charged together.
What is dowry? Any property given or agreed in connection with the marriage, before, at or after it. Mahr is excluded.
Which cases should you know?
How has CLAT asked about cruelty?
Ashwin and Ashima were married in February 2020. In March 2020, Ashwin asked Ashima to take care of all their household work, such as cooking, cleaning, and other domestic chores, as he was very busy with his professional responsibilities. Ashima claims that this amounts to treating her like a maid servant and constitutes an offence under Section 498A of the IPC. Applying the Bombay High Court decision, is she likely to succeed?
Reveal answer + reasoning
- A โ Right reason, wrong conclusion.
- C โ Nothing says she worked for others.
- D โ The passage says actual maid-servant treatment is an offence.
In April 2020, Ashwin's friend Rakesh visits Ashwin and Ashima's home, and stays with them for a few days. During his visit, he is very mean to Ashima, and uses abusive language with her. He also threw a plate at her one evening when he was unhappy with the meal that she had prepared. Ashima now claims that Rakesh has committed an offence under Section 498A of the IPC. Is she likely to succeed?
Reveal answer + reasoning
- A โ Nothing justifies throwing a plate.
- B โ Cruel conduct, wrong person.
- D โ Staying there doesn't make him a relative.
Frustrated and upset with her marriage, Ashima applies for and is granted a divorce from Ashwin in November 2020. โฆ She moves into her own apartment and starts going to office regularly at a new job. Ashwin is very upset at this and starts treating Ashima very cruelly. Ashima again claims that Ashwin has committed an offence under Section 498A of the IPC. Is she right?
Reveal answer + reasoning
- A โ Cruelty alone isn't enough.
- B โ 'Has been' isn't 'is'.
- C โ His feelings are irrelevant.
Also asked: Q69 added an imagined law making chores an offence, with compensation, reaching back three years. Key B: compensation yes, old offence no. A criminal conviction can't be retrospective, but a civil remedy can. Q70: conduct after an amendment falls under it. Key A.
