โšก The short answer
The Special Marriage Act is India's civil marriage law: any two adults, of any faith or none, can marry without converting. After a 30-day public notice, during which objections are allowed only on legal grounds, they marry before a Marriage Officer and three witnesses. Inheritance then usually follows secular succession law.
๐ŸŽฌ The 30-second story
Zoya and Aarav want a court marriage
1
โ€œDifferent faiths, and neither of us is converting. Can we still marry?โ€
๐Ÿ’
Zoya
Zoya and Aarav, both 24.
2
โ€œEasy. We walk into the office tomorrow and sign.โ€
๐Ÿ›๏ธ
Aarav
Aarav plans nothing.
3
โ€œI object: they're from different religions!โ€
๐Ÿ“‹
Rohan
A neighbour reads the notice board.
4
โ€œA waiting period? And he can stop us?โ€
โณ
Zoya
The plan meets the rulebook.
Tara's ruling: Not tomorrow: notice first, then 30 days. Rohan may object only on a legal condition, like an existing spouse. 'Different religions' is no ground; that is the Act's whole point.

What is the Special Marriage Act, and who can use it?

Most Indian marriages run on personal law, which assumes both parties share a faith, or one converts. The Special Marriage Act is the exit door: a secular, civil marriage open to any two persons who meet its conditions. Interfaith, inter-caste, or two people of the same faith who want no rituals: all welcome.

Who can marry under the Special Marriage Act?

There are four conditions, and none of them is about religion or caste. If any one fails, the marriage is void: treated as though it never happened.

๐Ÿงฉ At a glance
The four conditions
๐Ÿ’”No living spouse
Strict monogamy, even for a man whose personal law allows more wives.
๐Ÿง Sound mind
Able to give valid consent.
๐ŸŽ‚Age
Man at least 21, woman at least 18.
๐ŸŒณNot too closely related
Outside the prohibited degrees, unless a custom of at least one party allows it.

All four must hold on the date of marriage.

How do the 30-day notice and objections work?

The Act puts a public window before the wedding, so anyone who knows of a secret first spouse can speak up.

๐Ÿ•’ Timeline
From notice to certificate
  1. ๐Ÿ
    Before
    Residence
One party has lived in the district for 30 days.
  2. ๐Ÿ“
    Day 0
    Written notice
Entered in a public Marriage Notice Book and pinned up in the office.
  3. ๐Ÿ“ข
    Days 1โ€“30
    Objection window
Anyone may object, but only that a legal condition is broken.
  4. ๐Ÿ”
    If objected
    Inquiry
Officer decides within 30 days; a refusal can be appealed to the district court.
  5. ๐Ÿ’
    Day 31+
    Solemnisation
Each says to the other, before the officer and three witnesses, "I take thee to be my lawful wife (or husband)". Any ritual may be added.
  6. ๐Ÿ“œ
    After
    Certificate
    Conclusive evidence of the marriage.

One more clock: if the wedding doesn't happen within three months of the notice, the notice lapses and the couple starts again.

๐Ÿงญ Decision flow
Will the objection stop the marriage?
โ“ Raised within 30 days of the notice?
No โ†’
Too late to block the wedding.
Yes โ†“
โ“ Does it claim a legal condition is broken?
Caste, religion or family disapproval don't count.
No โ†’
Objection fails. The officer goes ahead.
Yes โ†“
โ“ After inquiry, is the objection proved?
Yes โ†’
Officer refuses to solemnise.
Either party can appeal to the district court.
No โ†’
Marriage goes ahead.

Isn't a public notice a privacy problem?

Critics say the notice board tips off hostile families. In Safiya Sultana (2021) the Allahabad High Court made publication optional on the couple's written request, but that binds only Uttar Pradesh. In Supriyo (2023) the Supreme Court expressly did not decide the point, so nationally it is still open.

Escapes an existing marriage?NoNo: conversion doesn't end the first marriage

Converting just to remarry while the first marriage subsists fails: the second is void and bigamous.

A couple married by religious rites can later register under this Act. Conditions are re-checked on the registration date (both must be 21+), and the marriage is then treated as made under the Act.

What happens to inheritance and the joint family?

This is the twist CLAT likes. A special marriage moves the couple's property onto the secular succession law (the one most Christians follow) instead of their religious law. A Hindu, Buddhist, Sikh or Jain joint-family member who marries this way is treated as leaving the joint family. Parliament softened this in 1976: if both spouses come from that group, neither rule applies.

๐Ÿงญ Decision flow
Which succession law applies to a special marriage?
โ“ Are both spouses Hindu, Buddhist, Sikh or Jain?
e.g. a Hindu and a Sikh
Yes โ†’
Hindu succession law continues; no exit from the joint family.
No โ†’
Secular succession law governs the couple and their children.
A Hindu spouse leaves the joint family.

How does a special marriage end?

โš”๏ธ Side by side
Void vs voidable special marriages
๐ŸšซVoid
Never a marriage
  • โ€ขA living spouse
  • โ€ขUnder age
  • โ€ขUnable to consent
  • โ€ขProhibited degrees
  • โ€ขRespondent impotent
โš ๏ธVoidable
Valid until annulled
  • โ€ขWilful refusal to consummate
  • โ€ขWife pregnant by another man at marriage
  • โ€ขConsent got by coercion or fraud

Children of both are legitimate.

One spouse can sue for divorce on a fault ground: adultery, cruelty, two years' desertion, and so on. Normally nobody can file in the first year of marriage. Or both can agree:

  1. 1
    Separate for a year
Lived apart one year or more.
  2. 2
    File jointly
Both present one petition. One spouse alone can't.
  3. 3
    Wait 6 to 18 months
Both move the court again in that window. Either can withdraw consent meanwhile.
  4. 4
    Inquiry and decree
The court checks the claims are true and the consent real.
โš ๏ธ Mutual consent must stay mutual
Consent got by fraud, or withdrawn before the decree, means no decree. A cruelty or adultery story doesn't turn a one-sided petition into a mutual-consent case.

Which cases shaped the Act?

๐Ÿ›ก๏ธ
Landmark case ยท 2006 ยท Supreme Court
Lata Singh v State of UP
๐Ÿ“‹
What happened
An adult woman married outside her caste. Her brothers threatened the couple and filed criminal cases.
โ“
The question
Can family disapproval justify harassment or prosecution?
๐Ÿ”จ
What the court held
No. An adult may marry whoever they like. Disapproving parents may at most cut social ties. The cases were quashed and police told to protect such couples.
What CLAT takes from it: Disapproval is not a legal objection.
๐Ÿ—๏ธ
Landmark case ยท 2018 ยท Supreme Court
Shafin Jahan v Asokan K.M. (Hadiya)
๐Ÿ“‹
What happened
An adult woman converted and married a Muslim man. On her father's petition, the Kerala High Court annulled the marriage.
โ“
The question
Can a court undo an adult's marriage because it doubts her choice?
๐Ÿ”จ
What the court held
No. Choosing a partner is part of personal liberty; the annulment was set aside.
What CLAT takes from it: No one can veto whom an adult marries.
๐Ÿณ๏ธโ€๐ŸŒˆ
Landmark case ยท 2023 ยท Supreme Court (5 judges)
Supriyo Chakraborty v Union of India
๐Ÿ“‹
What happened
Same-sex couples asked the Court to read the Act gender-neutrally, replacing 'husband' and 'wife' with 'spouse'.
โ“
The question
Can the Court rewrite the Act to allow same-sex marriage?
๐Ÿ”จ
What the court held
Unanimously no: that would be judicial legislation, for Parliament alone. There is no express fundamental right to marry. By 3:2 the Court also declined to recognise civil unions.
What CLAT takes from it: Changing who can marry is Parliament's job.

How has CLAT asked it?

CLAT 2022 built a five-question set on mutual-consent divorce under this Act. Each turns on one detail: who filed, when, or whether consent was real. Here are three.

๐Ÿ“ Asked in CLAT 2022 ยท Q87 One-sided petition
A special marriage, i.e., a marriage between persons from two different religious affiliations, can be legally contracted in India under the provisions of the law relating to special marriages. โ€ฆ In order to obtain a divorce by mutual consent, both the parties to the special marriage are required to jointly present a petition for divorce to the district court on the ground that they have been living separately for one year or more, that they have not been able to live together and that they have mutually agreed that the marriage should be dissolved. At least six months after the presentation of such petition, but not later than eighteen months after the presentation of such petition, the district court, after hearing the parties and after making the necessary inquiry, and being satisfied that the marriage is a special marriage, and that the claims made in the petition are true, shall declare the marriage to be dissolved. Further, the personal presence of the parties before the district court at the time of presenting the joint petition for divorce is not mandatory, as the parties can satisfy the court even by affidavit that the requirements for granting divorce on mutual consent are fulfilled.

(Facts trimmed) Ms. A, a Hindu, and Mr. B, a Christian, married under the law relating to special marriages in January 2018. On February 15, 2021, Ms. A presented a petition for divorce by mutual consent on the ground that they have been living separately for one year because Mr. B has been in an adulterous relationship with Ms. X. Which statement is correct?

AThe district court shall pass a decree of divorce by mutual consent six months after the date of presentation of petition for divorce.
BThe district court shall pass a decree of divorce by mutual consent eighteen months after the date of presentation of petition for divorce.
CThe district court shall not pass a decree of divorce by mutual consent as the requirements for grant of divorce are not fulfilled.
DThe district court shall not pass a decree of divorce by mutual consent as Ms. A and Mr. B have not been living separately for more than one year.
Reveal answer + reasoning
Answer: C
The rule needs both parties to file jointly. Ms. A filed alone, blaming Mr. B: a fault story, not mutual consent.
Why the others fail
  • A โ€” Assumes a valid joint petition.
  • B โ€” Same mistake.
  • D โ€” 'One year or more' is met. Right result, wrong reason.
๐Ÿ“ Asked in CLAT 2022 ยท Q89 Presence by video
Same passage.

(Facts trimmed) Same couple. On June 16, 2021, they jointly presented a petition for divorce by mutual consent, stating three years' separation and mutual agreement. Ms. A was physically present; Mr. B joined via video-conferencing. Which statement is correct?

AThe district court may pass a decree of divorce by mutual consent six months after the date of presentation of petition for divorce.
BThe district court shall pass a decree of divorce by mutual consent after all other legal requirements are fulfilled.
CThe district court shall not pass a decree of divorce by mutual consent.
DBoth (A) and (B).
Reveal answer + reasoning
Answer: D
Personal presence is not mandatory; even an affidavit will do, so video is no defect. The petition is joint and the separation exceeds a year, so a decree can follow from six months on, once other requirements are met. A and B both say that.
Why the others fail
  • C โ€” Treats physical presence as compulsory, which the passage expressly rejects.
๐Ÿ“ Asked in CLAT 2022 ยท Q90 Consent by fraud
Same passage.

(Facts trimmed) Same couple. On March 15, 2021, they jointly presented a petition for divorce, stating three years' separation and mutual agreement. Six months later, after inquiry, the court found the marriage was a special marriage, but Ms. A's consent to the petition was obtained by fraud. Which statement is correct?

AThe district court shall pass a decree of divorce by mutual consent because the legal requirements are fulfilled.
BThe district court shall pass a decree of divorce because the marriage had been solemnized under the law relating to special marriages.
CThe district court shall not pass a decree of divorce because there was no mutual consent between parties.
DThe district court shall not pass a decree of divorce because Ms. A has not been punished for fraud.
Reveal answer + reasoning
Answer: C
The court must find the petition's claims true, and the central claim is that both agree. Consent got by fraud isn't consent: no decree.
Why the others fail
  • A โ€” Real consent, the key requirement, fails.
  • B โ€” Necessary, not sufficient.
  • D โ€” Invents a condition the passage never mentions.
โ„น๏ธ The passage simplified the Act
The 2022 passage defined a special marriage as one between persons of different religions. The real Act is open to any two persons, same faith included. In the exam, go with the passage.

๐ŸŽฏ Quick quiz
Five fact patterns
0 / 5
Rule: notice goes to the officer of a district where one party has lived 30 days before notice. Kabir and his fiancรฉe moved to Indore 20 days ago and file there.

Q1. Is the notice valid?

Rule: anyone may object within 30 days that a legal condition (spouse, capacity, age, prohibited relationship) is broken. Meher's uncle objects that the groom is from another caste.

Q2. What should the officer do?

Rule: marriage after 30 days from notice; after three months, fresh notice is needed. Notice: 1 March. Wedding attempt: 20 June.

Q3. Can they marry that day?

Rule: a person married under the Act cannot remarry while the spouse lives. Rohan married under the Act, converted, then married again under his new faith's law.

Q4. Status of the second marriage?

Rule: if both spouses are Hindu, Buddhist, Sikh or Jain, Hindu succession law continues; otherwise secular succession law applies. A Sikh woman marries a Hindu man under the Act.

Q5. Which law governs his property?

๐ŸŽฏ In a nutshell
  • Civil marriage for any two persons; nobody converts.
  • Four conditions; breaking any makes it void.
  • 30-day notice, objections on legal grounds only, three witnesses.
  • Secular succession law, unless both spouses are Hindu, Buddhist, Sikh or Jain.
  • Mutual consent: a year apart, a joint petition, 6โ€“18 months, real consent.
๐Ÿ“Ž Good to know, not to memorise
  • Special Marriage Act 1954 (the 1872 Act required renouncing religion). s.4 conditions; ss.5โ€“14 notice to certificate; ss.15โ€“18 registration.
  • s.19 joint-family severance; s.21 Indian Succession Act 1925; s.21A exception (1976). ss.24โ€“25 void/voidable; s.27 divorce; s.28 mutual consent; s.29 one-year bar.
  • Lata Singh (2006) 5 SCC 475; Shafin Jahan (2018) 16 SCC 368; Safiya Sultana (All HC 2021); Supriyo Chakraborty (SC, 17 Oct 2023).

Frequently asked questions

Can two Hindus marry under the Special Marriage Act?
Yes. The Act is open to any two persons who meet its conditions, whatever their religion. Because both spouses are Hindu, they stay in their joint families and Hindu succession law keeps governing their property.
Is the 30-day notice compulsory?
The Act requires it. The Allahabad High Court in Safiya Sultana (2021) made publication optional on the couple's written request, but that binds only Uttar Pradesh. The Supreme Court has not settled it nationally.
Who can object to a special marriage?
Anyone, within 30 days of the notice, but only on a legal ground: an existing spouse, inability to consent, an under-age party or a prohibited relationship. Religion, caste or family approval are not grounds. A refusal can be appealed to the district court.
Did the Supreme Court allow same-sex marriage in 2023?
No. In Supriyo Chakraborty, all five judges held the Court cannot rewrite the Act in gender-neutral words; that is for Parliament. By 3:2 it also declined to recognise civil unions.
Can a special marriage end by mutual consent straight away?
No. The spouses must have lived apart for a year and file jointly. The court acts only between six and eighteen months after filing, once both confirm consent. Either can withdraw before the decree, and consent got by fraud doesn't count.
