Triple Talaq: From Practice to Offence

Three words used to end a marriage on the spot. Since 2017 they end nothing, and since 2019 saying them can land the husband in jail.

⚑ The short answer
Triple talaq (talaq-e-biddat) let a Muslim husband end his marriage instantly and irrevocably by pronouncing talaq three times at once. In Shayara Bano (2017) the Supreme Court set it aside 3:2. A 2019 law makes any such pronouncement void, so the couple stays married, and makes it a crime punishable with up to three years in jail.
🎬 The 30-second story
Three messages at midnight
1
β€œTalaq. Talaq. Talaq. We're done.”
πŸ“±
Aarav
After a fight, Aarav sends three WhatsApp messages.
2
β€œDid a text just end my marriage?”
πŸ’”
Zoya
Zoya reads them at 12:03 am.
3
β€œNani says three talaqs and it's over.”
πŸ“œ
Rohan
The neighbour quotes the old rule.
4
β€œThen why is the police station telling me to file an FIR?”
πŸš“
Zoya
Next morning.
Tara's ruling: That was the law before 2017. Today Aarav's messages are void, so Zoya is still his wife, and an offence, whatever the medium. Zoya can go to the police, claim a subsistence allowance and keep their child.

What exactly is triple talaq?

A Muslim marriage (nikah) is a contract, and the husband could dissolve it by talaq, a declaration of release. Two classical forms build in a pause for second thoughts. The third, talaq-e-biddat, had none: three pronouncements at one sitting, or one stated to be irrevocable, and the marriage ended that instant.

Its defining feature is irrevocability, not the number three. β€œI divorce you irrevocably”, said once, was biddat; β€œtalaq” once a month for three months was not.

πŸ“Œ What CLAT actually expects
The passage will define the modes of talaq or quote the 2019 law. Sort the facts: instant and irrevocable, or spread out and revocable? Who is accused, who complained? No section numbers needed.
🎚️ The scale
Three ways to pronounce talaq, from most to least reversible
← Room to reconcileNo way back β†’
Talaq-e-ahsan
One pronouncement, then the waiting period (iddat, about three months); revocable till it ends.
e.g. Resuming cohabitation during iddat cancels it.
Talaq-e-hasan
Three pronouncements in successive monthly cycles; the third is final.
e.g. Valid today, but under challenge.
Talaq-e-biddat
Three at once, or one stated as irrevocable. Final instantly.
e.g. Void since 2017; an offence since 2019.

Why was the instant form always the odd one out?

Even jurists who enforced it called talaq-e-biddat β€œbad in theology but good in law”. The Shia schools never accepted it; it survived in India through the Hanafi Sunni school.

How did triple talaq go from valid to void?

Courts chipped at it for decades before the Constitution Bench finished it off; Parliament then added a penalty.

How did the Supreme Court split 3:2?

Shayara Bano, married in 2001, received a talaqnama (written deed) in 2015 recording three talaqs at once. She asked the Supreme Court to declare it void and the practice unconstitutional. The result was 3:2, but the majority reached it by two different roads.

⚠️ No single majority reason
Only two judges found an Article 14 violation; one struck it down as un-Islamic. An option saying β€œthe Court unanimously held it violates equality” is wrong twice.

What does the 2019 Act add?

After 2017 instant talaq simply didn't work, but Parliament thought the practice continued. So the 2019 Act wrote β€œvoid” into statute and made the pronouncement a crime. It covers biddat and any similar instant, irrevocable form, however delivered: spoken, written, email, SMS or WhatsApp.

  • Wife β†’ Police: informs: cognizable
  • Police β†’ Husband: may arrest

The offence is the husband's alone. In Rahna Jalal the Supreme Court held that a mother-in-law named in the FIR cannot commit it. Relatives may still face other charges, such as cruelty.

What about a complaint from a stranger?

Police can arrest without a warrant only when the wife or a relative by blood or marriage informs them. A neighbour or activist can't trigger it. CLAT loves who-told-the-police twists.

What is still allowed, and what is still open?

Only the instant form died. The slow, revocable forms and the wife's own routes out of a marriage are untouched.

ℹ️ Three questions still open
Challenges to the Act's criminal part are pending in the Supreme Court; critics ask why a void act deserves jail. Other petitions question talaq-e-hasan and nikah halala. Until rulings come, apply the passage.

Which cases shaped the law?

πŸ“‹
What happened
Married fourteen years, she received a written deed recording three talaqs at once.
❓
The question
Is talaq-e-biddat valid law in India?
πŸ”¨
What the court held
Set aside 3:2. Two judges: manifestly arbitrary (Article 14). One: contrary to the Quran. Two dissenters would have protected it but paused it for six months.
What CLAT takes from it: An instant, irrevocable talaq has no legal effect. Count the reasons, not just the votes.
πŸ”
Landmark case Β· 2002 Β· Supreme Court
Shamim Ara v State of UP
πŸ“‹
What happened
Resisting his wife's maintenance claim, a husband pleaded he had divorced her years earlier, with no details.
❓
The question
Does a bare plea of an earlier talaq end the marriage?
πŸ”¨
What the court held
No. Talaq must be pronounced and proved, for a reasonable cause, after a reconciliation attempt by two arbiters. Maintenance continued.
What CLAT takes from it: Saying β€œI divorced her” in court papers isn't a talaq.
πŸ‘΅
Landmark case Β· 2020 Β· Supreme Court
Rahna Jalal v State of Kerala
πŸ“‹
What happened
A wife's FIR named her husband, who allegedly pronounced triple talaq, and her mother-in-law, who was refused anticipatory bail.
❓
The question
Can she be accused under the Act, and is anticipatory bail barred?
πŸ”¨
What the court held
Only a Muslim husband can commit the offence. The Act doesn't bar anticipatory bail, but the court must first hear the wife.
What CLAT takes from it: Read β€œaccused” strictly, and remember the wife's right to be heard on bail.

How could CLAT ask it?

No CLAT UG paper from 2018 to 2025 set a triple talaq passage, so these are CLAT-style questions we wrote.

πŸ§ͺ CLAT-style practice (not a past question) Instant vs spread out
Any pronouncement of talaq by a Muslim husband upon his wife, by words spoken or written, in electronic form or in any other manner, shall be void and illegal. For this purpose, talaq means talaq-e-biddat or any other similar form of talaq having the effect of instantaneous and irrevocable divorce pronounced by a Muslim husband. Any Muslim husband who pronounces such talaq shall be punished with imprisonment up to three years and fine.

Imran pronounces talaq once in each of January, February and March, living apart from his wife throughout. Has he committed the offence?

AGuilty, because he pronounced talaq three times.
BNot guilty under this rule, because no single pronouncement had an instantaneous and irrevocable effect.
CGuilty, because every pronouncement of talaq is void and illegal.
DNot guilty, because spoken talaq is outside the rule.
Reveal answer + reasoning
Answer: B
Here β€œtalaq” means only the instant, irrevocable kind. Spread over three months, each pronouncement left room to revoke (the hasan form), so the definition isn't met.
Why the others fail
  • A β€” The count is irrelevant; the effect matters.
  • C β€” β€œAny pronouncement of talaq” is limited by the definition.
  • D β€” The rule expressly covers spoken words.
πŸ§ͺ CLAT-style practice (not a past question) Apply the reasoning
Two judges held that a practice allowing a marital tie to be broken capriciously and whimsically, without any attempt at reconciliation to save it, is manifestly arbitrary. A law that enforces such a practice violates the guarantee of equality before the law and is void to that extent.

Suppose a statute allowed either spouse of any religion to end a marriage instantly by one written notice, with no reason and no reconciliation stage. Applying only this reasoning, the statute would be:

AValid, because it treats husbands and wives equally.
BValid, because it is a secular law, not personal law.
CManifestly arbitrary, because the tie can be broken capriciously with no attempt at reconciliation.
DVoid only for Muslim couples.
Reveal answer + reasoning
Answer: C
The test is caprice plus no reconciliation, not who holds the power or which religion applies. The hypothetical statute has both defects.
Why the others fail
  • A β€” Equal access to an arbitrary power doesn't cure the arbitrariness.
  • B β€” The reasoning applies to any law enforcing such a practice.
  • D β€” Nothing in the reasoning turns on religion.

🎯 Quick quiz
Five fact patterns
0 / 5
Rule: talaq having instantaneous and irrevocable effect, pronounced in any manner, is void and an offence. Salman writes once to his wife: β€œI divorce you, finally and irrevocably.”

Q1. Is the letter caught by the rule?

Rule: any Muslim husband who pronounces such talaq shall be punished. The FIR also names his sister-in-law, who urged him on.

Q2. Can the sister-in-law be prosecuted for this offence?

Rule: an ahsan talaq becomes final only when the waiting period ends; till then the husband may revoke by words or conduct. Arif pronounces talaq once and moves back in a month later.

Q3. What is the status of the marriage?

Rule: talaq must be pronounced and proved; a bare claim in court papers does not dissolve a marriage. Facing a maintenance claim, Kamal writes, β€œI divorced her long ago,” with no date or witness.

Q4. Is the wife still entitled to maintenance as a wife?

Rule: the offence is compoundable at the wife's instance with the Magistrate's permission. The couple reconcile; she asks to close the case and the Magistrate agrees.

Q5. Can the case end this way?

🎯 In a nutshell
  • Biddat was instant and irrevocable; sunnah forms allow a waiting period and revocation.
  • Shayara Bano (2017): set aside 3:2, by two routes, Article 14 arbitrariness and un-Islamic.
  • 2019 Act: pronouncement void, she stays married, he faces up to three years.
  • She gets allowance and custody, controls compounding and is heard on bail.
  • Only the husband is accused. Ahsan, hasan, khula, mubarat and judicial divorce remain.
πŸ“Ž Good to know, not to memorise
  • Muslim Women (Protection of Rights on Marriage) Act 2019: s.2(c) talaq; s.3 void; s.4 punishment; s.5 allowance; s.6 custody; s.7 cognizable, compoundable, bail. Deemed in force from 19 Sept 2018.
  • Shayara Bano v Union of India (2017) 9 SCC 1 (22 Aug 2017): Articles 13, 14, 25, 142.
  • Shamim Ara v State of UP (2002) 7 SCC 518; Rahna Jalal v State of Kerala (SC, 17 Dec 2020); Rashid Ahmad v Anisa Khatun (PC, 1931).

Frequently asked questions

Is triple talaq banned in India?
Yes. The Supreme Court set aside instant triple talaq in Shayara Bano in 2017, and the 2019 Act makes any instant, irrevocable talaq void and punishes the husband with up to three years in jail and a fine. Talaq in the slower, revocable forms is outside the Act.
If a husband pronounces triple talaq, is the couple divorced?
No. The pronouncement is void, so the marriage continues and she remains his wife. That is why the Act calls her a married Muslim woman and gives her a subsistence allowance and custody of minor children, while the husband is prosecuted.
Does triple talaq over WhatsApp or SMS count?
Yes. The Act covers talaq spoken or written, in electronic form or any other manner. A text, email or letter counts exactly like saying it aloud. What matters is whether it is meant to end the marriage instantly and irrevocably.
Was the Shayara Bano judgment unanimous?
No, it was 3:2. Justices Nariman and Lalit held instant talaq manifestly arbitrary under Article 14; Justice Kurian Joseph held it un-Islamic. Chief Justice Khehar and Justice Nazeer dissented, treating it as protected faith, but would have barred it for six months while Parliament legislated.
Is talaq-e-hasan still valid?
Yes, for now. Talaq-e-hasan spreads three pronouncements over three monthly cycles, so it isn't instant and falls outside the 2019 Act. Petitions questioning it are pending in the Supreme Court. For CLAT, apply the rule the passage gives.
Can a Muslim wife end the marriage herself?
Yes. She can seek khula, usually by giving up her dower; agree to mubarat, divorce by mutual consent; use a power of talaq delegated to her; or ask a court to dissolve the marriage on grounds such as cruelty or failure to maintain.
